The San Diego County Sheriff’s Department has decided to reject California state sanctuary policy, announcing this week that it will provide the records of criminally arrested illegal immigrants to federal authorities.

An official statement indicated Thursday that the department will be the first local or state law enforcement agency to comply with a slew of recent administrative subpoenas issued by U.S. Immigration and Customs Enforcement in five sanctuary states, including Colorado, Connecticut, New York and Oregon, The Associated Press reported.

According to Sheriff William Gore’s statement, however, the decision was not political, nor did it have anything to do with willful “cooperation.”

Instead, it was a conclusion reached out of “obligation” to the rule of law.

“A federal subpoena creates a mandatory legal obligation and is not ‘cooperation.’ The disobedience of a lawfully issued subpoena can be punishable by contempt of federal court,” Gore wrote, revealing federal authorities had requested the arrest and jail records of four specific individuals apparently suspected of immigration violations.

“The information requested by the subpoenas relates to the providing of documents, not honoring detainers and transferring individuals to ICE. These subpoenas deal only with records and information,” the statement read. “As such, the Sheriff’s Department is legally obligated to provide these records and will be doing so under that obligation.”

The department did clarify that it does not generally coordinate or cooperate with the U.S. Department of Homeland Security or its enforcement arms, as it is prevented from doing so by the California Values Act.

Signed into law in October 2017, Democratic Senate Bill No. 54 effectively prohibits local and state law enforcement agencies from voluntarily using resources or manpower to aid DHS in enforcing federal immigration law. It made California the first official “sanctuary state.”

The bill does not, however, provide guidance on local and state response to lawfully issued federal subpoenas.

Questions have since been raised as to the legal backing behind ICE‘s most recent slew of administrative subpoenas, which the AP reported were signed by an unnamed immigration official rather than a federal judge.

Regardless, U.S. Attorney for the Southern District of California Robert Brewer reportedly told the AP that Gore’s department has already complied with two of the four subpoenas issued. The remaining two are due next week.

The announcement comes close on the heels of recent attempts by the Trump administration to tamp down more strongly on major sanctuary cities and states.

Traveling out West for a four-day trip this week, the president spoke strongly regarding the issue of local cooperation with immigration enforcement at a series of rallies, news events and even the 2028 Los Angeles Summer Olympics preparations briefing.

“I think it’s terrible,” Trump told reporters at the Tuesday briefing. “I think sanctuary cities, as you know, are very dangerous. You just look at some of the horrific crimes that are committed — that wouldn’t happen if you didn’t have sanctuary for criminals.

“With L.A., San Francisco and other places,” the president added. “They have one thing in common: the leadership. There’s no reason that this should have ever happened.”

Unable after roughly three years to force compliance with federal law enforcement in some of the nation’s most vehement illegal immigrant sanctuaries, the Trump administration signaled last week that DHS would be mobilizing more than 100 U.S. Customs and Border Patrol tactical operators to carry out necessary raids without local support.

The Department of Justice has also moved this month to file lawsuits against the states of California, New Jersey and Washington, seeking court rulings on the legality of federally funded local and state agencies refusing compliance and cooperation with federal enforcement efforts, The New York Times reported.

I think the House will be retaken with a larger advantage in the Senate.

...with his polls in the teens from Black voters...if it rises above 15% mathematically impossible for the Dims to win nationally...if those polls rise to the 20's then they lose the 50 or so seats you are stating...Latino polling is putting him near the 25%...it will crush the Dims everywhere but California..."it's going to be a very hot spring and summer"...:)

The party of "the people" is at it again......

New York State Democrats may have found a way to get rid of Rep. Alexandria Ocasio-Cortez and they won’t need to primary her to do it.

As we have reported the state of New York could lose at least one congressional seat in 2020 after the Census and it could be Ocasio-Cortez’s seat on the chopping block.

“New York is expected to lose a House seat after the 2020 Census, and state Democrats are looking to draw out AOC’s district,” Frank Luntz, a noted pollster, said.

Ocasio-Cortez has been working hard to get her constituents to fill out their census forms in order for her to keep her nice $170,000 a year job, The City reported.

“Our strategy is all about building trust in the community before the enumerators even come to your door,” the representative said.

“There’s been an increased use of one’s immigration status as a form of intimidation,” she said to The City.

The issue for her is that 47 percent of her district are foreign born and there is no telling what percentage are legal, thus there is a fear of taking an official government survey.

For Ocasio-Cortez, a full Census count is more than a matter of making sure her district gets all the funds and services it’s due. In a sense, her own political fortunes could hang in the balance.

A review by THE CITY, building on data and analysis by The Texas Tribune, suggests Ocasio-Cortez’ district could be particularly vulnerable to undercount because a little over a quarter of those living there are non-citizens.

That’s a higher percentage than any other congressional district in the state.

A Census undercount in Ocasio-Cortez’ district and elsewhere in the state could lead to the elimination of congressional districts — potentially setting off politically charged redistricting battles.

New York already is on track to lose up to two congressional seats during reapportionment due to population decline and slower rate of growth, according to a December report by Election Data Services.

Ocasio-Cortez’s deputy district director Naureen Akhter admitted to The City that there are a lot of illegal immigrants in her district who fear taking the survey.

“We have a high immigrant population, a lot of undocumented folks, a lot of distrust from the community in the government,” the deputy director said.

That is the reason President Donald Trump wanted to add the citizenship question. Illegal immigrants are not supposed to have representation in Congress.

Congress is designed to represent that interest of the United States’ citizens, not anyone who comes in and demands representation.

It is also the reason Democrats fought so hard against the citizenship question and ultimately won, with help from “conservative” Supreme Court Chief Justice John Roberts.

As for Ocasio-Cortez, she has been a headache to the Democrat Party and to her state, pushing Amazon to renege on its decision to bring one of its headquarters there and costing the state tons of jobs and revenue.

She also has gone toe to toe with House Speaker Nancy Pelosi who is the de facto head of the Democrat Party, which is likely why New York Democrats want to get rid of herthe easiest way possible.

If only the rest of The Squad could be removed from Congress this easily.

A previously incurious New York Times is now exposing members of the FBI crew who participated in fraud upon the FISA Court. Are the corrupt former top-tier FBI officials starting to position lower-level FBI participants as scapegoats?

Inside an insufferable article, engineered to defend the need for the DOJ and FBI to continue using FISA intelligence gathering information against U.S. persons, the New York times outlines Stephen M Somma as Case Agent 1, the handler for FBI confidential human source Stefan Halper.

(NYT) […] The Page report criticized an F.B.I. agent for ignoring that very procedure as part of half a dozen personal failings that included not passing on the information from the C.I.A., singling the agent out as “primarily responsible for some of the most significant errors and omissions.”

It identified this person only as Case Agent 1. But he is Stephen M. Somma, a counterintelligence investigator in the F.B.I.’s New York field office, people familiar with the Russia investigation said. The F.B.I. declined to comment. (link)

“Case Agent 1” is identified in the IG report as “primarily responsible for some of the most significant errors and omissions in the FISA applications.” Stephan Somma had the responsibility to verify the accuracy of information underpinning in the FISA application.

Somma was also the FBI handler for Stefan Halper, the Cambridge professor who contacted, met and secretly recorded Carter Page, Sam Clovis and George Papadopoulos while using an undercover FBI agent code-named Azura Turk as his assistant.

The exculpatory information gathered as a result of those wired recordings was ignored, never shared with the FISA court, and buried during the investigation in order to continue a false framework for the FBI to continue targeting the Trump officials.

So why is the New York Times exposing Stephan Somma now as “Case Agent 1” according to “people familiar with the Russia investigation”?

Given the timing, risk exposure, and the corrupt nature of the FBI officials involved in the investigation, it looks like the top of the Crossfire Hurricane team are throwing FBI case agent Stephen Somma under the same bus as FBI lawyer Kevin Clinesmith.

    Your thoughts?

The White House Council of Economic Advisers (CEA) estimated that 13 million Americans will have increased access to health care due to President Donald Trump’s executive action, according to a report released recently.

The CEA estimated that millions of Americans will have new health insurance access that is better tailored to their healthcare needs that were previously unavailable due to high healthcare prices and overregulation. The council attributed much of the increase to the president’s reforms to expand short-term limited-duration health insurance plans, association health plans (AHPs), and health reimbursement accounts (HRAs).

Short-term plans cost less than Obamacare plans because federal statute does not require the insurance plans to comply with all of Obamacare’s onerous insurance regulations; thus, they serve as a good alternative for many younger and healthier Americans.

The Trump administration’s rule allowed Americans to purchase short-term plans for up to 364 days and renew the plans for up to three years. The Barack Obama administration curbed these rules to encourage Americans to purchase Obamacare.

The CEA said that short-term plans could be half as expensive as Obamacare-compliant plans.

“Though these plans are more limited in coverage than the ACA-compliant insurance plans, they are priced at up to 60 percent less than the unsubsidized premium cost of ACA exchange plans and give consumers more insurance protection than being uninsured,” the council wrote.

AHPs allow small businesses to join together and benefit from the regulatory advantages that many large companies experience under health insurance rules. AHPs can serve employees in a city, county, state, or a particular industry across the nation.

The CEA wrote that up to five million Americans will likely enroll in either AHPs or short-term plans, with one million Americans likely to get newly insured as the result of the short-term plan expansion.

    The CEA wrote:

As a result of STDLI and AHP rules, the CBO and the U.S. Congress’s Joint Committee on Taxation estimates that over the next decade, roughly 5 million more people are projected to be enrolled in AHPs or short-term plans. Of this increase, almost 80 percent constitute individuals who would otherwise have purchased coverage in the small-group or nongroup markets. The remaining 20 percent (roughly 1 million people) are made up of individuals who are projected to be newly insured as a result of the rules.

The council wrote that roughly one million Americans will save money on their health insurance premiums by switching to short-term health insurance policies. It added that the savings could exceed 50 percent compared to an Obamacare-compliant plan.

The Trump administration also expanded a rule that would allow employers to offer their employees a tax-deferred account to purchase their own health insurance. HRAs enable American workers to maintain their health insurance coverage even if they were to leave their job.

The CEA said that up to 11 million workers will receive their more personally tailored health insurance coverage under HRAs.

“The Treasury Department estimated that 800,000 employers are expected to provide HRAs after being fully ramped up. In addition, it is estimated that there will be a reduction in the number of uninsured by 800,000 by 2029,” the council wrote. “From these employers’ HRA contributions, it is expected that firms will cover more than 11 million employees with individual health insurance by 2029.”

During his State of the Union address in February, President Trump said he has worked to lower health insurance premiums for all Americans.

“Before I took office, health insurance premiums had more than doubled in just five years. I moved quickly to provide affordable alternatives. Our new plans are up to 60 percent less expensive — and better,” the president said, touting the low cost of short-term plans.

The Armador County Sheriff’s department now appears to be walking back their initial claim of suicide in the death of DHS Whistle-blower Phillip Haney. In addition to the announcement the sheriff’s office has requested assistance from the FBI:
    upload_2020-2-24_17-59-20.jpeg
From Gateway Pundit – […] “Unfortunately, there was misinformation immediately being put out that we have determined Mr. Haney’s death to be a suicide. This is not the case. We are currently in the beginning phase of our investigation and any final determination as to the cause and manner of Mr. Haney’s death would be extremely premature and inappropriate. No determination will be made until all evidence is examined and analyzed.”

A judge has scheduled a pair of hearings for Tuesday in longtime Trump adviser Roger Stone’s criminal case, as she considers how to resolve a motion Stone’s defense filed seeking a new trial based on alleged misconduct by one of the jurors in his case.

U.S. District Court Judge Amy Berman Jackson, who sentenced Stone last week to more than three years in prison for impeding official investigations into Russian meddling in the 2016 presidential race, said in a brief order Monday that she plans to take up the juror-focused motion behind closed doors in her Washington courtroom at 2 p.m. on Tuesday.

    Docket Text:

MINUTE ORDER. It is ORDERED that on Tuesday, February 25, 2020 at 2:00 p.m. the Court will hold a sealed hearing on defendant’s currently sealed amended motion for a new trial [313], and at 1:30, it will hold a public hearing on defendant’s sealed motion [332] to open the 2:00 p.m. hearing, and the underlying pleadings, to the public. The hearings will take place in Courtroom 3 before Judge Amy Berman Jackson. SO ORDERED. Signed by Judge Amy Berman Jackson on 2/24/20. (DMK)
