    The former prosecutor, who’s worked with Durham, said his old colleague may start revealing developments from his case weeks in advance of the 60-day cut-off, or ideally right after the political conventions. The GOP convention, which follows the Democrats’ gathering, ends Aug. 27.

    “They are nervous about affecting the election, so timing is everything,” he said. “It will be tricky.”

    At the same time, the former Justice official said Durham could exploit a loophole in the department rule, memorialized in memos dating to 2008, that allows for action closer to the election. It states that “law enforcement officers and prosecutors may never select the timing of investigative steps or criminal charges for the purpose of affecting any election, or for the purpose of giving an advantage or disadvantage to any candidate or political party. Such a purpose is inconsistent with the Department’s mission.” (Emphasis added.)

    The operative phrase – “for the purpose of” – leaves leeway for actions close to an election that aren’t taken “for the purpose” of affecting the election. In other words, Durham wouldn’t necessarily have to lie low for the two months in the run-up to the election.


    Testing that loophole with an “October surprise” would almost certainly send Democrats and the Washington media into high dudgeon.

    Some are skeptical Durham will deliver at all, regardless of the deadline, while others question his reputation as a fierce prosecutor. They point to his nearly three-year investigation of CIA officials who destroyed videos of terrorist detainees allegedly being “tortured.” Congress had sought the evidence, but Durham closed the case in 2012 without filing any criminal charges. And his final report about what he found remains classified. In a 2018 criminal case, moreover, he cleared Comey’s general counsel, James Baker, of unauthorized leaks to the media.

    The Senate’s top FBI watchdog, Chuck Grassley, has grown frustrated with Durham’s lack of progress. “Durham sh[ou]ld be producing some fruit of his labor,” the Iowa senator groused in a recent tweet.

    Swecker attributes the sluggish pace of Durham’s sprawling probe to the COVID-19 health scare, which has restricted travel and grand jury meetings in the D.C. area. Durham’s team of investigators, who include retired FBI agents, has been operating out of his New Haven, Conn., offices. Besides Washington, they have taken trips abroad. Before the coronavirus outbreak, they interviewed authorities and other sources in Italy, Britain and Australia.


    In addition, Durham’s agents have been slowed by an avalanche of subpoenaed electronic media, including emails, texts and direct messages, “which are incredibly difficult and time-consuming to sort through,” Swecker said. Such evidence is not limited to FBI, Justice and CIA officials. Durham also has reportedly obtained, for instance, data and meta-data contained on two BlackBerry cellphones used by Joseph Mifsud, a shadowy Maltese professor who some believe was used by the FBI to create a predicate to open the original case against the Trump campaign.

    During last week’s House hearing, Rep. Tom McClintock, R-Calif., asked Barr if he would be able to “right this wrong” against Trump before the election.

    “I really can’t predict that,” the attorney general answered. “John Durham is looking at all these matters. COVID did delay that action for a while. But he’s working very diligently.”

    Added Barr: “Justice is not something you can order up on a schedule like you’re ordering a pizza.”


    McClintock warned Barr that if he is succeeded by a Biden appointee, Durham’s investigation will simply go away.

    “I understand your concern,” Barr sighed.

    Maybe Judge Luttig was right all along.

    I had the misgivings you’d expect back in late May, when I disagreed with J. Michael Luttig, the stellar scholar and former federal appeals court judge, regarding how the D.C. Circuit Court of Appeals should handle the Michael Flynn case.

    At the time, that court’s three-judge panel had not yet heard oral argument on Michael Flynn’s mandamus petition — i.e., Flynn’s request that the panel find that federal district judge Emmet Sullivan was acting lawlessly.


    Sullivan had not only failed to grant the Justice Department’s motion to dismiss the criminal case against Flynn; he had appointed a former federal judge (the overtly anti-Trump John Gleeson) to posit the argument abandoned by DOJ — to wit, that Flynn should proceed to sentencing because he had pled guilty to a false-statements charge, waiving his right to contest the case any further in exchange for the government’s agreement not to file any other charges.


    Basically, Flynn was asking the appellate court to order Judge Sullivan to dismiss the case.

    In Nevada, you can’t have more than 50 people meet for a religious service. However, the state’s lifeblood — casinos — can operate at 50 percent capacity, a much less strict restriction.

    If you’re Evangelicals for Trump, there’s an easy workaround to that: Hold a church service in a Las Vegas casino.

    The event took place at the Ahern Hotel and Convention Center in Las Vegas on Thursday, according to Fox News.

    The venue is one of Vegas’ numerous facilities that combine hotel and convention space with casino facilities.

    Headlined by Trump spiritual adviser Paula White, the church service took aim at the absurdity and arbitrary nature of Nevada’s worship restrictions — and received support from the Trump campaign.


    “In a time when many Nevadans can’t go to church because of overreaching restrictions, President Trump’s campaign is bringing together evangelicals from across the community to pray, worship and discuss key issues facing Americans in the November election,” said Trump 2020 deputy national press secretary Ken Farnaso, according to Fox News.

    Faith and Freedom Coalition chairman Ralph Reed tweeted a video of the event, showing proper social distancing.


    “Our president understands how important faith is to our country,” White said during the event, according to the Las Vegas Review-Journal.

    Officials in Las Vegas either don’t get irony or don’t take kindly to it, because they sent the Ahern Hotel and Casino a letter saying that “a determination has been made that this gathering for over fifty (50) persons will be in violation of the governor’s current directive for public and private gatherings.”

    “Your compliance is mandatory,” it stated. “Your failure to comply with all State directives and notices issued by the City may result in civil fines, license suspensions, and/or denial of your pending permanent licenses.”




    This apparently ended with Las Vegas spokesman Jace Radke announcing a $250 fine for both the event’s organizers and owner Don Ahern, The Associated Press reported.

    Reed and White both said Trump’s legal team blocked the event’s shutdown, according to the Las Vegas Review-Journal.

    The event was attended by 500 people in a venue that would have normally held 1,600; temperatures were taken and masks required.

    Nevertheless, Democratic Nevada Gov. Steve Sisolak took to Twitter to vent at the Trump campaign and the event organizers:



    “President Trump’s own campaign has ignored his experts and state law. This campaign event put more people at risk, including his supporters and the hardworking Nevadans who staffed the event,” Sisolak tweeted.


    “I’m calling on President Trump to focus on the real threat to the health & lives of Nevadans & Americans: the senseless spread of COVID-19. I’m calling on President Trump to order his campaign to follow our State’s protocols & his own health care experts’ strong guidance.”

    All right, governor. Close the casinos, then.

    The premise of this entire argument is that religious congregants can’t socially distance, but gamblers can. Sadly, the Supreme Court agrees.

    In a July 21 ruling, by a 5-4 margin, the high court ruled against Calvary Chapel Dayton Valley, a Nevada church that sued the state under the premise that the governor’s order unconstitutionally discriminated against religious assemblies, according to CBN News.

    The swing vote, as always, was Chief Justice John Roberts.

    “The governor allows hundreds to thousands to assemble in pursuit of financial fortunes but only 50 to gather in pursuit of spiritual ones. That is unconstitutional,” the church argued in court documents, according to CBN.

    In a dissent joined by Justices Brett Kavanaugh and Clarence Thomas, Justice Samuel Alito wrote that the “Constitution guarantees the free exercise of religion.”

    “It says nothing about the freedom to play craps or blackjack, to feed tokens into a slot machine, or to engage in any other game of chance,” Alito continued, adding Gov. Sisolak “apparently has different priorities.”

    “In Nevada, it seems, it is better to be in entertainment than religion,” said Justice Neil Gorsuch.

    “Maybe that is nothing new. But the First Amendment prohibits such obvious discrimination against the exercise of religion. The world we inhabit today, with a pandemic upon us, poses unusual challenges. But there is no world in which the Constitution permits Nevada to favor Caesars Palace over Calvary Chapel.”

    What Thursday revealed is that, even inside a casino, the state still views the religious individual as more of a threat than the gambler. However, nothing can keep churches from showing the absurdity of the regulations, even if the Supreme Court may disagree.

    "Somebody needs to go to jail for this," Graham said. "This is a second lie. This is a second crime. They lied to the FISA court. They got rebuked, the FBI did, in 2019 by the FISA court, putting in doubt all FISA applications ... a year before, they're lying to the Senate Intel Committee. It's just amazing the compounding of the lies."

    Graham said that he was not sure who specifically briefed the Senate Intelligence Committee on the subsource, but swore he would write to current FBI Director Christopher Wray to get to the bottom of the situation.

    "I'm gonna find out who did that briefing, and whoever it is, they're in trouble," Graham said.

    "Sunday Morning Futures" host Maria Bartiromo also asked Graham his thoughts on the Senate's hearing this week with former Acting Attorney General Sally Yates. Graham said his impression was that former FBI Director James Comey has a growing list of problems, which Graham intends to ask him about.

    "Everybody's throwing Comey under the bus," Graham said. "When I asked Sally Yates about the interview with Michael Flynn, orchestrated by Comey -- Was that okay? Was the proper? -- she said no, it was rogue."

    He added: "So you've got Rosenstein, now Sally Yates, saying if they knew then what they know now they wouldn't sign the warrant application, which means they're running away from Crossfire Hurricane, they're dumping it all on Comey, and that's probably the right thing to do."

    Today's COVID state update for 8/8/20 results

    New positive cases were 8,373 from 118,592 tests for a + rate of 7.06% up a little from yesterday
    Total rate of positive tests are at 6.27 now...
    the trending 14 day average is 6.1% just a tick up
    104 new deaths with total deaths at 10,293 with a mortality rate of a meager 1.857%

    Hospitalizations are down 110 to a total of 5,636
    ICU numbers dropped 137 to 1,731 ( some got out of ICU alive I see)

    The surge is pretty much history now... especially in the hospitals. The majority of new positives are
    among the 18-49 age group and their death rate is much lower than the older groups. Most either have mild
    symptoms or none at all.

    Stop the insanity and dictatorship

    add one more tidbit... LA county has 4,967 of the 10,293 deaths in the state, 48.25%
    were they all really COVID deaths? LA county accounts for a little more than a quarter of the state's population.

    Question: If President Trump’s foreign policy has not been effective, as his political opponents of suggested, then why would two of our biggest potential enemies want him gone?

    Because they do.

    Chinese President Xi Jinping and Iran’s Supreme Leader Ayatollah Khamenei both want the hapless Joe Biden to win the November election — because they both believe his policies will essentially return things to the bad ol’ days when those two countries ran roughshod over America.

    This is all the opinion of the U.S. intelligence community anyway, according to Just The News, which adds:

    China and Iran are both indicating a preference for Trump to lose, National Counterintelligence and Security Center Director William Evanina revealed in a statement on Friday; Russia, meanwhile, has shown a preference for Donald Trump to prevail in November.

    China, for instance, in recent months “has grown increasingly critical of the [Trump] Administration's COVID-19 response, closure of China's Houston Consulate, and actions on other issues,” Evanina said.

    The country “has been expanding its influence efforts ahead of November 2020 to shape the policy environment in the United States, pressure political figures it views as opposed to China's interests, and deflect and counter criticism of China,” he wrote. Chinese leaders see Trump as “unpredictable,” Evanina noted.

    Iran has also sought to “undermine U.S. democratic institutions, President Trump, and to divide the country in advance of the 2020 elections,” Evanina said, claiming that Iranian intelligence will likely utilize Internet agents to advance those goals.

    But Just The News adds:

    Russia, meanwhile, is “using a range of measures to primarily denigrate former Vice President Biden,” while “some Kremlin-linked actors are also seeking to boost President Trump's candidacy on social media and Russian television.”

    You know what that’s about, right?

    You guessed it: To perpetuate the ‘Russian collusion’ lie, because Vladimir Putin knows to do will continue to destabilize American politics.

    Hang on to your seats, folks. The ride only gets rougher from here on in.

    They’re already American owned complete with their own deep state moles. Now, take them out then maybe they’ll be journalist again.

    Right now they’re just a propaganda machine for the DNC.
